By placing an order you accept the following General Terms and Conditions of AMIRA PERTESI Online Store.
Right to exchange and return
You can return any item ordered from the AMIRA PERTESI online store within 14 days of receipt, without giving any reason, by using the mailing label provided to the following address:

Please also note that merchandise which is sent back has to be in a condition corresponding to a normal use for the purpose of checking the merchandise – as would be usual for trying it on in a store – and that they must still have the original tags on them. We reserve the right to demand compensation for items returned in poor condition due to additional usage. The costs for the return shipment will be borne by the customer. Please follow the instructions of withdrawal according to Item 8 below.

2. Delivery/shipping costs
AMIRA PERTESI online shop delivers to all countries mentioned. We offer FREE shipping. Delivery time is approx. 10 to 15 working days upon receipt of a complete and correct order.

We deliver to Austria, Belgium, Bosnia and Hercegovina, Croatia, Czech Republic, France, Germany, Hungary, Italy, Luxembourg,  Serbia, Slovakia, Slovenia, Spain. We do not deliver to other countries than the aforementioned.

Import duties and taxes for Bosnia and Hercegovina and Serbia are not included in the price of the goods you purchase. The transit time is not subjected to the procedure of import customs clearance.
3. Prices and payment methods
All prices in the AMIRA PERTESI Online Shop are tax free (small business exemption regulations). All prices are indicated in Euros.

You can choose whether you wish to pay the merchandise by MasterCard, Visa Card, American Express, Diners Club, SOFORT Überweisung or PayPal. You will receive your invoice attached to the delivery.

Should you fall into default in payment, AMIRA PERTESI is entitled to invoice default charges amounting to EUR 5.00. Furthermore, in the event of default in payment, the customer undertakes to compensate for all costs incurred due to adequate measures taken for collecting outstanding debts, e.g. legal process costs, default interests at an amount permitted by law, expenses, costs for debt collection (e.g. costs for a licensed collection agency and a hired lawyer) as well as handling charges.
4. Acceptance of orders
The Operator is free to refuse online orders. It is at the Operator’s sole discretion whether it accepts an order. In the event that the Operator cannot carry out an online order, the Operator will notify the customer of this without delay.

The comma online store does not accept any orders from customers who are not yet 18 years old.

An order confirmation does not yet constitute a binding sales contract. The sales contract only takes effect after delivery of the goods.

The following steps are required to submit your binding order using the online shopping bag system: Please place the selected item(s) in the virtual shopping bag by clicking the “Shopping bag” button. You can open the shopping bag and make changes at any time by clicking on the identical button. After selecting a button, you can enter your personal data. On the following pages you select your delivery address, accept our T&C and select the payment method. You can also cancel the order, for example by closing your browser. The order process is completed only after pressing the “Buy now” button. Unless otherwise expressly stated in the item description, all items are delivered without any of the accessories that may be pictured.

5. Transport damage

The customer shall notify the respective delivery company immediately, regardless of his/her warranty rights, if items are delivered with obvious damage to the packaging or the contents. The customer shall refuse acceptance and contact the Operator at once using the phone number at +43 676 57 39 233* or in another manner (e-mail, post), so that the Operator can maintain any rights against the dispatcher.

6. Storage of contract text

The contract text is not saved by the Operator and can not be accessed after completing the order process. You can, however, print the order data immediately after having sent the order request.

7. Retention of title

The goods delivered remain the property of the Operator until they have been paid in full.

8. Legal instructions on withdrawal

Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the goods, in the case of partial deliveries, the last of the goods. To exercise the right to withdraw, you must inform us of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You may use the attached model withdrawal form for this purpose, but it is not obligatory.

You can also exercise your right of withdrawal by returning the goods pursuant to paragraph 1 or by returning the goods without comment. Unless the circumstances indicate otherwise, returning the goods without comment will be understood as a statement of withdrawal.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery, without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. The deadline is met if you send back the goods before the period of 14 days has expired. We will bear the cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

The following model withdrawal form complies with all statutory information requirements. It is not necessary to state your withdrawal separately, e.g. by using the form below. It is enough to return the goods without comment.

9. Data privacy and creditor protection

As a basic principle, all personal data will be handled confidentially. Your personal data collected are processed, used and saved for the purpose of handling and carrying out your order.

The payment options offered in our web-shop [(optionally list of available payment systems)] are processed securely and reliably by the several times awarded and certified payment service provider (PSP) mPAY24 GmbH. The company specializes in online payments and operates a payment platform for e-and m- commerce. mPAY24 is required to be audited to regular security audits as part of the certification according to the Payment Card Industry Data Security Standard (PCI DSS). The PCI DSS includes several recommendations and requirements related to technical aspects (handling of payment data, system architecture, software design) and internal processes (access rights, information policy). As an infrastructure provider mPAY24 GmbH is subject to the Payment Systems Oversight of the Austrian National Bank. mPAY24 has been the first Payment Service Providers certified with the EURO- Label. 10. Warranty

The consumer can make a claim under the warranty for purchased goods that are defective according to the legal regulations. In particular, the customer can demand supplementary performance (a new delivery or a repair of the defects). The AMIRA PERTESI online store is entitled, however, to replace the goods if the repair of defects would incur unreasonable costs. Warranty claims expire two years after the delivery of the goods. When making his/her warranty claim, the buyer must provide the order number, his/her name and address as well as brief information explaining the reasons for the claim. The content of this website is protected by copyright including all text, graphics, photos, illustrations, images, moving images, sounds and software. Downloading or use of the content is only authorised for private use. Any further publication, transmission, reproduction or other use of the images is forbidden.
